1. Acceptance of Terms

By accessing or using the website of Ellis Farrier Service, LLC ("Company," "we," "our," or "us"), located at ellisservicellc.com, or by scheduling, requesting, or receiving any farrier or hoof care services from Ellis Farrier Service, LLC, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions in their entirety. These Terms and Conditions constitute a legally binding agreement between you and Ellis Farrier Service, LLC.

If you do not agree to these Terms and Conditions, you must immediately discontinue use of our website and refrain from scheduling or receiving services from Ellis Farrier Service, LLC. Your continued use of our website or services constitutes your ongoing acceptance of these terms.

Ellis Farrier Service, LLC reserves the right to modify these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting to our website. It is your responsibility to review these terms periodically. Your continued use of our services following any changes constitutes acceptance of the revised terms.

2. Website Usage Rules

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the website. Prohibited uses include but are not limited to:

  • Transmitting any unsolicited or unauthorized advertising or promotional material
  • Attempting to gain unauthorized access to any part of our website or its related systems
  • Using the website in any way that could damage, disable, overburden, or impair our servers
  • Harvesting or collecting email addresses or other contact information from the website
  • Using automated tools, bots, or scrapers to access or collect data from our website
  • Impersonating any person or entity or misrepresenting your affiliation with any person or entity
  • Submitting false, misleading, or fraudulent appointment requests or contact information

Ellis Farrier Service, LLC reserves the right to terminate your access to our website at any time, without notice, for any conduct that we, in our sole discretion, believe violates these terms or is harmful to other users, us, or third parties, or for any other reason.

3. Service Scheduling Policies

All farrier service appointments with Ellis Farrier Service, LLC are scheduled based on availability and geographic location within our service area. Appointment requests submitted through our website, by phone, or by text message are considered requests only and are not confirmed until you receive direct confirmation from Ellis Farrier Service, LLC.

We make every reasonable effort to honor scheduled appointments. However, Ellis Farrier Service, LLC reserves the right to reschedule appointments due to weather conditions, equipment issues, prior appointment overruns, animal emergencies, or other circumstances beyond our control. We will provide as much advance notice as possible in the event of a scheduling change.

Clients are responsible for ensuring that horses are available, accessible, and properly prepared for their scheduled appointment time. Failure to have horses ready at the scheduled time may result in additional waiting fees, shortened service time, or rescheduling of the appointment.

Ellis Farrier Service, LLC serves clients throughout Southwest Missouri and surrounding areas. Service availability outside our primary service area is subject to travel fees and scheduling availability. Please contact us to confirm service availability for your specific location before scheduling.

4. Appointment Requirements

To ensure a safe and productive farrier appointment, clients must meet the following requirements:

  • A responsible adult (18 years or older) must be present at the property during the entire appointment
  • Horses must be caught, haltered, and ready for service at the scheduled appointment time
  • A safe, level working area with adequate lighting must be available for the farrier to work
  • Horses must be reasonably clean and dry, particularly around the hooves and lower legs
  • All dogs and other animals must be secured and away from the work area during the appointment
  • Any known behavioral issues, health conditions, or special handling requirements must be disclosed prior to the appointment
  • Clients must provide accurate location information and ensure the property is accessible by vehicle

Failure to meet these requirements may result in the appointment being shortened, rescheduled, or cancelled, and may result in applicable fees as described in our Refund and Cancellation Policy.

5. Animal Safety Disclaimer

Working with horses and other large animals involves inherent risks. Ellis Farrier Service, LLC takes all reasonable precautions to ensure the safety of both the animals and our staff during service appointments. However, the client acknowledges and accepts that horses are unpredictable animals and that farrier work involves physical contact with the animal's hooves and legs.

Ellis Farrier Service, LLC is not responsible for any injury to the horse, other animals, or persons that results from the horse's behavior, movement, or reaction during or after a farrier appointment. Clients are responsible for disclosing any known behavioral issues, health conditions, or history of difficult handling prior to scheduling.

In the event that a horse's behavior poses an unreasonable safety risk to our farrier or staff, Ellis Farrier Service, LLC reserves the right to discontinue the service appointment. In such cases, a service call fee may still apply for travel and time already expended.

6. Horse Handling Responsibilities

The client is solely responsible for the behavior and management of their horses during farrier appointments. While Ellis Farrier Service, LLC will work patiently and professionally with horses of varying temperaments, the client must be present and available to assist with horse handling as needed.

Clients are responsible for ensuring their horses are accustomed to basic handling and hoof picking prior to farrier appointments. Horses that have never had their hooves handled may require additional time and patience, and clients should disclose this information when scheduling.

Ellis Farrier Service, LLC may recommend sedation for horses that are extremely difficult to handle safely. The decision to sedate a horse is the sole responsibility of the client and their veterinarian. We do not administer sedation and are not responsible for arranging veterinary services.

7. Cancellation Policies

We understand that circumstances change and that cancellations are sometimes unavoidable. To respect the time and scheduling commitments of our farrier and other clients, we ask that you provide as much advance notice as possible when cancelling or rescheduling an appointment.

Cancellations made with less than 24 hours' notice may be subject to a cancellation fee. Repeated last-minute cancellations may result in a requirement for advance payment before future appointments are scheduled. Please refer to our Refund Policy for complete details on cancellation fees and refund eligibility.

No-shows (failure to be present at a scheduled appointment without prior notice) will be treated as late cancellations and may be subject to applicable fees. Ellis Farrier Service, LLC reserves the right to require prepayment from clients with a history of no-shows or late cancellations.

8. Travel Fee Policies

Ellis Farrier Service, LLC is a mobile farrier service and travel fees may apply for appointments located outside our primary service area or beyond a standard travel radius from Carthage, Missouri. Travel fees, when applicable, will be disclosed at the time of scheduling and will be included in the total service cost.

Travel fees are non-refundable once the farrier has departed for your location, regardless of whether the service appointment is completed. If a client cancels an appointment after the farrier has already begun traveling to the location, the full travel fee will be charged.

Fuel costs, road conditions, and travel time are factored into our travel fee structure. Travel fees are subject to change and will be communicated clearly before any appointment is confirmed.

9. Emergency Service Terms

Ellis Farrier Service, LLC offers emergency hoof care services for urgent situations such as lost shoes, cracked hooves, hoof injuries, or other conditions requiring immediate attention. Emergency service requests are accommodated based on availability and may be subject to emergency service rates.

Emergency service rates are higher than standard service rates to reflect the priority scheduling, after-hours availability, and disruption to existing schedules that emergency calls require. Emergency service rates will be communicated before the appointment is confirmed.

Ellis Farrier Service, LLC does not guarantee availability for emergency service requests. We will make every reasonable effort to respond to emergency situations promptly, but cannot guarantee same-day or immediate service in all cases. For life-threatening animal emergencies, please contact your veterinarian immediately.

10. Payment Terms

Payment for farrier services is due at the time of service unless alternative arrangements have been made in advance. Ellis Farrier Service, LLC accepts cash, check, and major credit/debit cards. Accepted payment methods will be confirmed at the time of scheduling.

Returned checks will be subject to a returned check fee in addition to the original service amount. Clients with returned checks may be required to pay by cash or money order for future services. Accounts with outstanding balances may be subject to collection proceedings.

Service prices are subject to change without notice. Current pricing will be provided at the time of scheduling. Ellis Farrier Service, LLC reserves the right to adjust pricing based on the complexity of the service, number of horses, travel distance, and other relevant factors.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELLIS FARRIER SERVICE, LLC, ITS OWNERS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES OR WEBSITE.

In no event shall Ellis Farrier Service, LLC's total liability to you for all claims arising from or related to our services exceed the total amount paid by you for the specific service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

12. No Guarantee Disclaimer

While Ellis Farrier Service, LLC strives to provide the highest quality farrier services, we cannot guarantee specific outcomes for any horse's hoof health, soundness, performance, or comfort. Hoof care results depend on many factors beyond our control, including the horse's genetics, diet, environment, exercise level, overall health, and compliance with recommended care schedules.

Our website and marketing materials describe the types of services we offer and general benefits of regular farrier care. These descriptions are not guarantees of specific results for any individual horse. Ellis Farrier Service, LLC makes no warranties, express or implied, regarding the outcome of any farrier service.

If you have concerns about your horse's hoof health or soundness, we recommend consulting with a licensed veterinarian in addition to maintaining regular farrier appointments. Farrier services are complementary to, not a replacement for, veterinary care.

13. Intellectual Property Rights

All content on the Ellis Farrier Service, LLC website, including but not limited to text, graphics, logos, images, photographs, audio clips, digital downloads, and data compilations, is the property of Ellis Farrier Service, LLC or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without the prior written consent of Ellis Farrier Service, LLC, except as follows: you may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use.

The Ellis Farrier Service, LLC name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Ellis Farrier Service, LLC. You must not use such marks without our prior written permission.

  • Ensuring a safe working environment for our farrier and staff
  • Being present or having a responsible adult present during all service appointments
  • Maintaining current vaccinations and health records for your horses as required by applicable regulations
  • Paying for services rendered in a timely manner
  • Providing adequate notice for appointment cancellations or rescheduling
  • Complying with all applicable local, state, and federal laws regarding animal ownership and care

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms and Conditions or your use of our services shall be brought exclusively in the state or federal courts located in Jasper County, Missouri.

You consent to the personal jurisdiction of such courts and waive any objection to the laying of venue of any such action or proceeding in Jasper County, Missouri. You also waive any right to a jury trial in connection with any action or litigation in any way arising out of or related to these Terms and Conditions.

17. Indemnification

You agree to defend, indemnify, and hold harmless Ellis Farrier Service, LLC, its owners, officers, employees, agents, contractors, and successors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use of our website or services
  • Your violation of these Terms and Conditions
  • Your violation of any third-party rights, including intellectual property rights
  • Any injury or damage caused by your horses or animals during a service appointment
  • Your failure to provide accurate information about your horses or property
  • Your failure to maintain a safe working environment for our farrier

Ellis Farrier Service, LLC reserves the right to revise and update these Terms and Conditions at any time in our sole discretion. All changes are effective immediately when posted on our website. Your continued use of our website or services following the posting of revised Terms and Conditions means that you accept and agree to the changes.
